Purpose

This Name, Image, and Likeness (NIL) Compliance Policy outlines BreakPoint Marketing’s approach to partnerships with student-athletes in accordance with NCAA rules, state and federal law, and individual institutional policies. We’re committed to empowering athletes while operating with full transparency and integrity.

 

 

What is NIL?

NIL allows student-athletes to earn compensation for the use of their:

 

  • Name

  • Image

  • Likeness

 

This includes brand partnerships, appearances, social media endorsements, licensing, and other marketing engagements.

 

BreakPoint Marketing NIL Commitments

We agree to the following in every NIL engagement:

 

1. Compliance with NCAA & Institutional Rules

We will:

 

  • Respect and follow NCAA guidelines

  • Adhere to athlete-specific school compliance procedures

  • Notify appropriate institutions as required (where applicable)

 

 

2. Fair Compensation

We compensate athletes fairly and transparently for their services and never offer pay-for-play or performance-based incentives.

 

 

3. Written Agreements

Every NIL arrangement is governed by a written contract that outlines:

 

  • Scope of work

  • Compensation terms

  • Timeline and deliverables

  • Termination clause

  • Required disclosures

 

 

4. No Inducements or Recruiting Violations

We do not:

 

  • Use NIL deals to influence a recruit’s college decision

  • Offer NIL in exchange for athletic performance or enrollment

 

 

5. Transparency & Disclosures

We encourage athletes to disclose their NIL arrangements per school policy and ensure that our campaigns are:

 

  • Transparent

  • Clearly labeled (e.g., #ad on social media)

  • In full alignment with FTC guidelines for advertising

 

 

How We Work With Athletes

  • We evaluate athlete partnerships based on brand fit, audience alignment, and mutual value.

  • We never ask athletes to act against institutional policy or personal brand guidelines.

  • We provide support with content guidance, contract clarity, and compliance documentation when needed.

 

 

Privacy & Data Protection

Any personal information we collect as part of NIL partnerships is handled in accordance with our Privacy Policy and is never sold, shared, or exploited beyond agreed-upon terms.
